This is a legal agreement between you and Sweet Video Chat and various future versions including the web version (“All Sweet services will be collectively referred to as “Sweet”) regarding the use of Sweet’s software programs and related documentation that is installed on your device (the “Software”). By downloading the Software and/or using any of the services enabled by the Software (the “Services”), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (INCLUDING ANY ADDITIONAL GUIDELINES AND FUTURE MODIFICATIONS) AND BY SWEET’S PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE AND CAN BE FOUND AT HTTPS://SWEETVIDEOCHAT.COM/LEGALS/PRIVACY. IF AT ANY TIME YOU DO NOT AGREE TO THESE TERMS AND TERMS OF USE, YOU MAY NOT USE THE SOFTWARE OR SERVICES AND MUST IMMEDIATELY TERMINATE YOUR USE OF THE SOFTWARE AND ALL SERVICES.

Acknowledgment. This paragraph applies if you have downloaded the Software from application marketplaces such as the Apple App Store and Google Play. Sweet and you acknowledge that these Terms of Use are concluded between Sweet and you solely, and not with the application marketplaces, and as between Sweet and the marketplaces, Sweet, not the marketplaces, is solely responsible for the Software and Services and their content.

License Grant. Subject to your compliance with the terms and conditions set forth in these Terms of Use, Sweet grants you a personal, limited, non-commercial, non-exclusive, non-sublicensable, non-assignable, and revocable license to download, install, and use one (1) copy of the Software in object code form only on your personal computer or mobile device (the "Device") for the sole purpose of your personal use of the Sweet application.

Ownership. The Software is protected by copyright laws and international treaties concerning copyright, as well as other intellectual property laws and treaties. The Software includes trade secrets and confidential and proprietary information of Sweet.

Restrictions. You are only licensed to use the object code version of the Software. You may not copy, modify, adapt, translate into any language, distribute, or create derivative works based on the Software or any of the Services.

Additional Restrictions. You may not use the Software or any of the Services for any illegal or unauthorized purpose.

Device Use: If your use of the Software or Services depends on the use of bandwidth controlled by a third party, you acknowledge that your license to use the Software is subject to obtaining the relevant third party's consent for such use.

Content: Content transmitted through the use of the Software and Services is the sole responsibility of the person from whom such content originated.

Your Content: You are responsible for the content you transmit or display through the Software or Services.

Third Parties: The Software may incorporate technology owned and controlled by third parties.

New Versions of the Software: Sweet reserves the right to add additional features or Modify the Software or Services.

Third-Party Fees: For certain devices, Sweet may ask your permission to use your native SMS application to send messages.

Eligibility: The license to use the Software and Services is void in any jurisdiction where prohibited.

No Access to Emergency Services: The Software and Services are not intended to support emergency calls.

Prevention of Unauthorized Use: Sweet reserves the right to use legal means to prevent unauthorized use of the Software or Services.

License Grant to Sweet: You authorize Sweet to collect and use the contact lists contained on the devices where you have downloaded the Software.

Premium Services: From time to time, Sweet may provide additional features that are paid for ("Premium Services").

Payments for Premium Services: Premium services may be offered on a subscription or per-use basis.

Refunds: You may request a full refund for any purchased premium services if permitted by the app store from which you downloaded the software.

Termination by You: You may terminate your use of the services at any time. by uninstalling the software.

Termination by Sweet: Without limiting other remedies, Sweet may limit, suspend, or terminate these Terms of Use and/or your use of the software or services for any reason.

Content Storage: Sweet will make reasonable efforts to store your content if such storage is a feature provided with the premium service.

Third Party Sites, Products, and Services; Links: The Services may include links to other websites or services as a convenience to our users.

Coins and Paid Services: Sweet may offer additional features that require the use of virtual coins ("coins") or paid services ("Premium Services"). Coins can be acquired through the application and used to access special features or exclusive content.

Payments: Premium services may be offered on a subscription basis, per use, or as described at the time of purchase. By purchasing coins or premium services, you agree to pay all charges to your account, including applicable taxes, in accordance with the billing terms in effect at the time the charges are due.

Refunds: You may request a full refund for any premium service purchased if permitted by the app store from which you downloaded the software. Exceptions include users who have been banned by Sweet, and full refunds are not available for partially used purchases.

Non-refundable Coins: Once coins have been used, spent, or exchanged for any service or feature within Sweet, they are strictly non-refundable. Refunds will not be granted for coins that hayan sido consumidos parcial o totalmente, independientemente de la razón. Only unused coins may be eligible for a refund, and solely at Sweet's discretion and in accordance with the policies of the app store or payment processor.

Termination by User: You may terminate your use of the services at any time by uninstalling the software. If you have subscribed to premium services, you are responsible for directly completing all payment obligations with the app store and/or payment processing service.

Termination by Sweet: Sweet may limit, suspend, discontinue, or terminate the terms of use and/or your use of the software and services for any reason, including breach of the terms, legal issues, late payment, intellectual property infringement, or fraudulent, immoral, or illegal activity.

Limitation of Liability: To the maximum extent permitted by law, Sweet and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

Disclaimer of Warranties: The services and software are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Sweet does not warrant that the services will be uninterrupted, secure, or error-free.

Indemnification: You agree to indemnify, defend, and hold harmless Sweet, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your use of and access to the services, or your violation of these terms.

Modifications to Terms: Sweet reserves the right to modify these Terms of Use at any time. Any changes will be effective upon posting the revised terms on the application or website. Your continued use of the services after such changes constitutes your acceptance of the new terms.

Governing Law and Jurisdiction: These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which Sweet operates, without regard to its conflict of law provisions. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in such jurisdiction.

Severability: If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
